Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant has met the criteria for grant of stay of execution pending appeal.
  2. 2 Whether the application for stay was made without unreasonable delay.
  3. 3 Whether the applicant will suffer substantial loss if stay is not granted.

Ratio Decidendi

The court found that although there was a slight delay in filing the application for stay, it was not unreasonable given the explanations provided. The applicants demonstrated that they would suffer substantial loss if evicted from the suit property, as the loss would be irreversible and render the appeal nugatory. The court emphasized the need to balance the rights of both parties and preserve the subject matter pending appeal. The applicants were required to furnish security for due performance of the decree, and the amount was set at Kshs. 100,000 to be deposited in court within 60 days. Failure to comply would vacate the stay. Costs of the application were ordered to be in the appeal.

Court Disposition

Application for stay of execution pending appeal allowed on condition of security.
