The plaintiff's subsequent refusal to execute transfer documents was contrary to the sale agreement and the evidence overwhelmingly supported the defendant's counterclaim. The court held that the defendant is entitled to be declared the lawful owner and to have the transfer executed, either by the plaintiff or, in default, by the Deputy Registrar.
