Section 6 of the Arbitration Act requires that a party seeking to stay proceedings in favour of arbitration must do so not later than the time of entering appearance and before filing any pleadings. Data Rush Services Ltd filed a defence to the counterclaim before raising the preliminary objection, thereby waiving its right to rely on the arbitration clause.
