Ratio Decidendi

The court found that the Respondents terminated the Claimant’s employment without providing any reason and without subjecting him to the mandatory disciplinary procedure as required by law. This contravened Sections 41 and 43 of the Employment Act, 2007. The absence of a valid reason and failure to follow due process rendered the termination both substantively and procedurally unfair. Consequently, the Claimant was entitled to compensation for unfair termination, salary in lieu of notice, and gratuity for the full term of the contract. Claims for salary for the remainder of the contract and general damages were dismissed for lack of legal basis.
