Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimants’ employment was lawful and fair.
  2. 2 Whether the Claimants are entitled to the remedies sought.

Ratio Decidendi

The court found that while redundancy is a lawful ground for termination, the Respondent failed to comply with the mandatory procedural requirements set out in Section 40 of the Employment Act, 2007. The Respondent admitted non-compliance with these provisions, which include proper notification and payment of statutory dues. The court held that such failure rendered the termination of the Claimants’ employment unfair within the meaning of Section 45 of the Act. Consequently, the Claimants were entitled to compensation based on their respective periods of service, but other claims not supported by evidence were dismissed.

Court Disposition

Judgment for the Claimants in part; compensation for unfair termination awarded; other claims dismissed.

Orders
