Procedural Posture

Originating Summons / Ruling on Interlocutory Injunction Application

  1. 1 Whether the plaintiffs have acquired ownership of L.R No. 209/10914 by adverse possession.
  2. 2 Whether the plaintiffs are entitled to a temporary injunction restraining the 1st defendant from interfering with their possession pending determination of the suit.

Ratio Decidendi

The court found that the plaintiffs failed to establish a prima facie case for adverse possession because the 1st defendant was only registered as owner of the suit property on 6th March 2014, and the suit was filed approximately one and a half years later, far short of the twelve-year statutory period required for adverse possession. There was also insufficient evidence to prove the plaintiffs' occupation of the property for the requisite period. Consequently, the plaintiffs did not meet the threshold for the grant of a temporary injunction, as they could not demonstrate a probability of success in their claim for adverse possession.
