Procedural Posture

Originating Summons / Ruling on Interlocutory Injunction Application

  1. 1 Whether the Plaintiff, an unincorporated society, has locus standi to institute proceedings in its own name or through its officials.
  2. 2 Whether the Plaintiff has established a prima facie case for grant of an interlocutory injunction restraining the Defendants from evicting its members from L.R. No. 14750/2.
  3. 3 Whether the supporting affidavit and documentation meet the requirements under Order 37 Rule 7 of the Civil Procedure Rules for adverse possession claims.

Ratio Decidendi

The court found that the Plaintiff, being an unincorporated society, lacked the legal capacity to sue in its own name and that the affidavits in support of the application were defective as the deponent did not disclose his official capacity within the Plaintiff. Furthermore, the Plaintiff failed to annex a certified extract of the title showing the Defendants as registered proprietors of the suit property, as required for claims of adverse possession. Consequently, the Plaintiff lacked locus standi, and the application was unmeritorious both procedurally and substantively. The court struck out the application for being bad in law.
