The court found that the taxing officer erred in principle by striking out the entire bill of costs due to the inclusion of an item for fees for attending taxation, contrary to paragraph 69(3) of the Advocates Remuneration Order. The court held that there is no provision that inclusion of such an item vitiates the entire bill; only the offending item should be struck out. The drastic action of striking out the entire bill was unwarranted and based on a flimsy ground. The court set aside the taxing officer's order and directed that the bill of costs be submitted for taxation before a different taxing officer.
