Ratio Decidendi

The Court found that the sum awarded to the Claimant was compensation for unfair termination, which is in the nature of general damages and only ascertainable upon judgment. Therefore, interest on the decretal sum is to be calculated at Court rates from the date of the decree (26th October 2023) until payment in full. Any execution process or warrants that calculated interest for periods prior to the date of decree, or used different calculations, were invalid. The Court allowed the Respondents' application to the extent that interest is only due from the date of decree and set aside any contrary execution processes. Each party was ordered to bear its own costs for the application.
