The applicants are not listed as beneficiaries and their claim is derivative. The court held that the respondents were within their rights to file the succession cause in Marsabit, and the applicants would not suffer prejudice if the matter is heard there. The Kadhi in Marsabit can visit the suit land or hear witnesses elsewhere if necessary. The application for transfer was therefore dismissed for lack of merit.
