The court determined that, despite the withdrawal of the main suit in ELCC 1286/2014, the counterclaim and the suit ELCC 579/2015 remain live and distinct. The lead file for prosecution of the counterclaim and related suit will be ELCC 1286/2014 (as consolidated with ELCC 579/2015). The court found that further consolidation with ELCLC E096/2024 is premature due to pending applications and preliminary objections in that matter, and directed that ELCLC E096/2024 be returned to the court handling it for resolution of those issues. The court preserved the liberty of parties to formally apply for consolidation at a later stage, and scheduled mentions for further directions in both matters.
