Procedural Posture

Employment Cause / Judgment

  1. 1 Is the claimant entitled to service gratuity pay upon early retirement?
  2. 2 Is the claimant entitled to salary for March 2017 after applying for early retirement?.

Ratio Decidendi

The court found that the claimant voluntarily applied for early retirement and there was no evidence of an agreement, private treaty, or contractual provision entitling him to service gratuity. Statutory deductions had been made, and in the absence of a specific agreement, service pay was not due. The claimant was only entitled to wages for the four days worked in March 2017. The claim for gratuity and full March salary was dismissed. The respondent was ordered to pay the claimant for the days worked and issue a certificate of service as required by law. Each party was to bear its own costs.

Court Disposition

Orders
