The Court found that the applicant failed to satisfy the two conditions required for a stay of execution under rule 5(2)(b) of the Court of Appeal Rules: (1) she did not demonstrate that the intended appeal was arguable, particularly in light of established jurisprudence on adverse possession and the effect of registration; and (2) she failed to show that the appeal would be rendered nugatory if stay was not granted, as she still held the title documents and there was no evidence of imminent transfer or demand by the respondent. Consequently, the application for stay of execution was dismissed.
