Ratio Decidendi

The Plaintiff failed to comply with the conditional order for reinstatement of the suit as set out in the Ruling of 25th November, 2016, specifically by paying the thrown away costs outside the stipulated 14-day period and by not paying the auctioneers' fees. No application for enlargement of time was made, nor was a plausible explanation for non-compliance provided. As a result, the suit stands dismissed by operation of the court's prior order. Consequently, there is no subsisting suit to which additional parties can be joined, rendering the present application for joinder of parties incompetent. The application is therefore dismissed with costs to the 1st and 2nd Defendants.
