Ratio Decidendi

The Supreme Court found that the applicants failed to provide sufficient evidence to support their claim that the delay was caused by their advocates. The receipts provided related only to legal fees for the Court of Appeal and not for filing an appeal in the Supreme Court. Furthermore, the applicants were aware of the Court of Appeal judgment as of 1st March 2016, but did not file the application for extension of time until 18th January 2017, almost a year later. The Court held that the applicants had not demonstrated reasonable cause for the delay nor that the application was brought without undue delay. Consequently, the Court dismissed the application for enlargement of time.
