Procedural Posture

Land and Property Suit / Judgment

  1. 1 Whether the plaintiffs have a right to ownership or occupation of land parcel Miti Mingi/Mbaruk Block 5/4253 after its sale by public auction.
  2. 2 Whether the defendant lawfully acquired title to the suit land as an innocent purchaser for value.
  3. 3 Whether the plaintiffs are entitled to remain on the suit land or should be evicted.

Ratio Decidendi

The plaintiffs failed to tender any evidence to support their claim of ownership or to demonstrate fraud in the defendant's acquisition of the suit land. The defendant proved he purchased the property lawfully at a public auction after the bank exercised its statutory power of sale, paid the required consideration, and obtained proper registration. As the registered proprietor, the defendant is entitled to exclusive possession and enjoyment of the land under Section 25 of the Land Registration Act. The plaintiffs have no legal right to remain on the property and must vacate. The defendant's counterclaim for possession and injunction is merited and allowed.

Court Disposition

Plaintiffs' suit dismissed; defendant's counterclaim allowed.
