Procedural Posture

Injunction Application / Ruling on Interlocutory Application

  1. 1 Whether the Plaintiff has established a prima facie case with a probability of success to warrant a temporary injunction.
  2. 2 Whether orders can be issued against the County Land Registrar who is not a party to the proceedings.
  3. 3 Which party should bear the costs of the application.

Ratio Decidendi

The court found that the Defendant is the registered proprietor of the disputed land and is entitled to all rights and privileges of such ownership until her title is successfully challenged in accordance with the law. The Plaintiff failed to establish a prima facie case with a probability of success to warrant the grant of a temporary injunction. Furthermore, any loss the Plaintiff may suffer is compensable by an award of damages. The court also held that it cannot issue orders against the County Land Registrar, who is not a party to the proceedings, as this would contravene the principles of natural justice. Consequently, the Plaintiff's application was dismissed for lack of merit.

Application dismissed with costs in the cause.
