Ratio Decidendi

The court found that the Malindi Land Disputes Tribunal acted ultra vires by purporting to determine the rightful owner of registered land, a jurisdiction exclusively reserved for the High Court under the Registered Land Act. The tribunal's decision to order the transfer and registration of land was therefore null and void, as was the subsequent judgment of the Principal Magistrate adopting the tribunal's award. The applicant, having obtained a grant ad litem, had sufficient locus standi to bring the judicial review proceedings. Accordingly, the orders of certiorari were merited and granted, quashing both the tribunal's award and the judgment of the Principal Magistrate.
