Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the respondent is liable for claims arising after the claimant's resignation from its employment.
  2. 2 Whether the claimant is entitled to unpaid half salary during suspension.
  3. 3 Whether the respondent is liable for the claimant's loss of employment at Kibabii University.

Ratio Decidendi

The court found that the respondent was only liable for the uncontested claim of unpaid half salary during the claimant's suspension, as the employment relationship had ended upon the claimant's resignation. No cause of action existed against the respondent for losses suffered by the claimant in his subsequent employment at Kibabii University, as there was no evidence that the two universities were the same legal entity or that the respondent was responsible for the claimant's termination at Kibabii. The claim for a release letter was also dismissed as meritless. Judgment was entered for the claimant only in respect of the unpaid half salary, with interest and costs.

Court Disposition

Partly allowed for uncontested half salary claim; all other claims dismissed.
