Ratio Decidendi

The court found that the Respondent failed to comply with the mandatory procedural requirements of Section 40 of the Employment Act, 2007, in effecting the redundancy. There was no evidence that the Claimant or the labour officer was notified in writing, nor that the selection criteria for redundancy were observed. As a result, the termination was both substantively and procedurally unfair. The Claimant was therefore entitled to compensation for unfair termination, salary arrears, notice pay, leave pay, and severance pay. The claims for gratuity and damages for loss of income were dismissed for lack of contractual or statutory basis. The Claimant was also awarded costs and interest.

Judgment for the Claimant.

Orders

  • The Respondent shall pay the Claimant 12 months’ salary in compensation for unfair termination (Kshs. 332,196).
  • The Respondent shall pay the Claimant salary for January 2015 (Kshs. 27,683).
