Procedural Posture

Civil Appeal / Ruling on Preliminary Objection

  1. 1 Whether the appellants required leave of the court to file the appeal against the ruling of the magistrate.
  2. 2 Whether the appeal filed without leave is competent and properly before the court.

Ratio Decidendi

The High Court held that the right of appeal is not automatic and must be expressly provided for by statute. In this case, the orders appealed from were made under Sections 1A, 1B, and 3A of the Civil Procedure Act, which are not among those listed under Order 43(1) of the Civil Procedure Rules for which an appeal lies as of right. Therefore, the appellants were required to seek and obtain leave of the court before filing the appeal. Since no leave was sought or granted, the appeal was incompetent and the court lacked jurisdiction to entertain it. The preliminary objection was upheld and the appeal was dismissed as a nullity.

Court Disposition

preliminary objection upheld; appeal dismissed as incompetent

Orders

  • The preliminary objection is allowed.
  • The appeal is dismissed as incompetent.
