The court found that although the applicant's counsel was not diligent and made errors in the affidavits and in pursuing the appeal, the applicant himself should not be penalized for his counsel's mistakes. The court noted that the grounds of appeal were weighty and that the extension of time would not prejudice the respondent. The delay, while attributable to counsel's lack of diligence, was not inordinate once proceedings were supplied. In the interests of justice and fair hearing under Article 50 of the Constitution, the court exercised its discretion to grant leave to appeal out of time, with costs personally borne by the applicant's counsel.
