Ratio Decidendi

The court found that although the objection to the grant of letters of administration was filed by the objector, the court had not issued the notice required under section 68(2) of the Law of Succession Act for the objector to file an answer and cross application. As such, the delay in progressing the objection could not be attributed to the objector. The application to strike out the objection was therefore premature and without basis, as the statutory process had not been completed. The court dismissed the application and directed the Deputy Registrar to issue the necessary notice to the objector to take the required procedural steps.
