The court found that the applicant had established a case for stay of execution pending appeal. The decision of the Land Disputes Tribunal and the Provincial Appeals Committee, if executed, would cause substantial loss to the applicant, who holds a title deed to the disputed land. Interference with registered land is inherently prejudicial to the registered owner. The court further held that no prejudice would be caused to the respondent if the stay is granted, as both parties are brothers who have occupied and used their respective parcels since registration. The interests of justice require that the appeal be heard and determined on its merits before any execution of the decree....
