Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the award of general damages by the trial court was manifestly excessive in the circumstances.
  2. 2 Whether the trial magistrate properly evaluated the evidence and applied the correct principles in assessing damages for personal injuries.
  3. 3 Whether the special damages awarded were proved to the required standard.

Ratio Decidendi

The court found that the trial magistrate's award of general damages was excessive when compared to recent awards for similar injuries. The respondent sustained a fracture of the right tibia, right ankle dislocation, chest contusion, laceration, and cut wounds, which were proved by medical evidence. However, comparable cases indicated that a lower award was appropriate. The court substituted the general damages with Kshs 450,000/- and upheld the special damages of Kshs 57,410/-, both subject to interest as specified. The court also found that the appellant was entitled to half the costs of the appeal.

Court Disposition

Appeal partially allowed. General damages reduced; special damages upheld.

Orders
