Ratio Decidendi

The court found that the applicant had not demonstrated that the respondent would be unable to repay the decretal sum if the appeal succeeded, and thus had not established substantial loss as required by Order 42 rule 6 of the Civil Procedure Rules. However, considering the circumstances and the need to balance the interests of both parties, the court exercised its discretion to grant a stay of execution of the Small Claims Court judgment pending the hearing and determination of the appeal. The applicant was directed to file the record of appeal within 60 days, and costs of the application were awarded to the respondent.
