The court found that the Respondent's publication of the press notice on 29 July 2009 constituted a clear repudiation and frustration of the employment contract, which the Claimant became aware of immediately. The limitation period for bringing a claim therefore began to run from that date. Since the Claimant only filed the suit on 7 October 2014, more than three years after the cause of action arose, the claim was statute barred under section 90 of the Employment Act, 2007.
