The Respondent admitted the debt and default, and the Applicant had issued a redemption notice, satisfying the statutory preconditions for sale. The court held that the economic impact of the COVID-19 pandemic did not excuse continued default in 2024. The Applicant was entitled to exercise its remedies, including sale of the charged property, but only with leave of the court, which was granted. The court also awarded costs to the Applicant, as it was the successful party.
