The court found that the applicant had demonstrated a legitimate apprehension that the ongoing procurement proceedings would render its substantive judicial review application nugatory if not stayed. The court was satisfied that the applicant had been granted leave to file the substantive application and that, unless a stay was granted, the subject matter of the dispute would be overtaken by events, thus defeating the purpose of the judicial review.
