The court found that while the application for stay was made without undue delay and the appellant offered to deposit the decretal amount as security, the appellant failed to demonstrate by affidavit evidence that substantial loss would result if stay was not granted. The appellant did not provide evidence that the respondent would be unable to repay the decretal sum if the appeal succeeded, nor did the appellant show that execution would render the appeal nugatory. Mere assertions by counsel were insufficient. As a result, the appellant did not satisfy the requirements of Order XLI Rule 4(2) of the Civil Procedure Rules, and the application for stay was dismissed.
