Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the charge sheet was defective for citing a non-existent offence under the Alcoholic Drinks Control Act.
  2. 2 Whether the plea of guilty entered by the appellant was unequivocal.
  3. 3 Whether the sentence imposed was excessive and supported by law.

Ratio Decidendi

The court found that the appellant was charged under a non-existent provision of the Alcoholic Drinks Control Act, rendering the charge sheet defective and incapable of supporting a conviction. Furthermore, the plea of guilty was not unequivocal as the facts were not properly explained to the appellant, and the court failed to comply with the established procedure for plea taking as set out in Adan v. Republic. The sentence imposed was excessive and unsupported by law, especially given the absence of a lawful conviction and the failure to consider alternative sentencing options. Consequently, the conviction and sentence could not stand.
