There was insufficient evidence of fraud. The central issue of whether plot 346 is the same as plot 222 could only be resolved at trial. However, the plaintiff was in possession and running a business, and the 4th defendant had failed to clarify the location of plot 346. The balance of convenience therefore favored the plaintiff.
