Ratio Decidendi

The court found that the Respondent failed to comply with the procedural fairness requirements under section 41 of the Employment Act, 2007, as the Claimant was not given a fair hearing or proper notice before dismissal. The evidence did not establish that the Claimant was underpaid during the relevant period, as his wages met or exceeded the statutory minimum. The claim for loss of prospective future earnings was unsupported by contractual or statutory basis and was therefore declined. The Claimant was awarded one month’s wage in lieu of notice and six months’ gross wages as compensation for unfair dismissal, but claims for underpayments and future earnings were dismissed.
