The Court found that the applicant provided a plausible and satisfactory explanation for the delay in serving the notice of appeal, namely the unavailability of the superior court file until January 2023. The period of delay, approximately three months, was not considered inordinate in the circumstances. The intended appeal was found to raise arguable points of law deserving consideration. The respondent did not demonstrate undue prejudice that would result from the extension. Accordingly, the Court exercised its discretion under Rule 4 of the Court of Appeal Rules to allow the application for extension of time, ordering that the notice of appeal be served within seven days.
