Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant has met the conditions for grant of stay of execution pending appeal under Order 42 Rule 6 of the Civil Procedure Rules.

Ratio Decidendi

The court found that the applicant had demonstrated substantial loss would occur if evicted from the suit land, given his long occupation and the existence of a family home. The application was made promptly after the expiry of the grace period for vacating the land, thus there was no unreasonable delay. Although the applicant had not expressly offered security for costs, the court exercised its discretion to impose a condition requiring a deposit of Kshs 100,000 as security. The court concluded that the applicant had satisfied the requirements for a stay of execution pending appeal under Order 42 Rule 6 of the Civil Procedure Rules and granted the stay on the stated condition.

Court Disposition

Application allowed with conditions.

Orders

  • A stay of execution of the judgment delivered on March 2, 2022 is granted pending appeal on condition that the applicant deposits Kshs 100,000 in court as security for costs within 30 days, failing which the order for stay shall automatically lapse.
  • The costs of the application shall be borne by the applicant.
