The court found that the partition and issuance of new title deeds to the respondent was effected while an appeal was pending and in contravention of a restriction placed by the applicant. The respondent was aware of the pending appeal and contributed to the mistake by accepting title and taking possession. Section 143 of the Registered Land Act empowers the court to rectify the register where registration was obtained by fraud or mistake. The court held that the applicant was entitled to rectification of the register and cancellation of the new titles, as well as eviction of the respondent, as these orders were consequential to the judgment on appeal in the applicant's favour.
