The court found that the preliminary objection raised by the respondent did not meet the threshold of a pure point of law as it required fact finding and was therefore dismissed. On the application for stay, the court held that the best interests of the minor children, who were of tender age and had been living with their mother, required that the status quo be maintained pending the determination of the appeal. The father’s failure to avail himself for interview by the Sub-County Children’s Officer further supported the grant of stay.
