The Tribunal found that although the original lease was for a fixed term of ten years and would not ordinarily be a controlled tenancy, the landlord's acceptance of rent from the tenant for the months of May and June 2022 after the lease had expired constituted the creation of a periodic tenancy. Section 60(2) of the Land Act provides that if a lessor continues to accept rent from a tenant who remains in possession for two months after the termination of the lease, a periodic lease from month to month is deemed to have come into force.
