The Tribunal found that as at the time of the application, the tenant had cleared the rent arrears that formed the basis for the distress and attachment of goods. The only outstanding issues were the release of the tenant's goods and the proper determination of auctioneer's fees. The Tribunal held that while the landlord was entitled to levy distress for rent arrears, the auctioneer was not entitled to unilaterally appropriate part of the rent as his fees absent an agreement. The sum of Kshs. 130,000 received by the auctioneer as purported fees was to be credited to the tenant's account and paid to the landlord.
