Ratio Decidendi

The Tribunal found that the Respondent was properly served with the claim and hearing notice but failed to respond or attend the hearing. The Claimant's evidence, including savings passbook and statements, was uncontested. Applying Order 10 Rule 4(1) of the Civil Procedure Rules, the Tribunal held that the Claimant was entitled to judgment for the liquidated sum claimed, as there was no evidence of refund or dispute from the Respondent.
