Ratio Decidendi

The court found that the issue of the constitutionality of the Murang’a County Finance Act, 2013, specifically regarding public participation, had already been determined in Murang’a High Court Constitutional Petition No 24 of 2014. In that case, the court held that there was indeed public participation before the enactment of the Act. As such, the court held that it would not permit the same issue to be litigated again in the present petition. Consequently, the application seeking to restrain the respondent from enforcing the new cess/levy was dismissed.
