Ratio Decidendi

The court held that the defendant could not, on his own motion, join a new party to the proceedings without first obtaining leave of court. The further amended defence and counterclaim filed without such leave was therefore struck out. Furthermore, the Mortgage (Special Provisions) Act does not permit the inclusion of parties other than the mortgagor and mortgagee in proceedings under the Act. Since the court had previously declined to grant an order for possession, the suit could not proceed in the manner the defendant sought, and issues relating to the sale of the charged property or alleged illegal charges could not be entertained in this suit.
