Ratio Decidendi

The court held that the application for stay of execution was not maintainable because the appeal was not against the summary judgment dated 21st November 2002, which was the only executable order. The appeal was instead against the dismissal of the application for review dated 23rd December 2002, which is not an executable order. Order XLI Rule 4(1) of the Civil Procedure Rules only empowers the court to stay execution of a decree or order appealed from, not one that is not the subject of an appeal. Therefore, the court lacked jurisdiction to grant a stay of execution in these circumstances, and the application was dismissed with costs to the respondent.
