Ratio Decidendi

The court found that the 2nd to 10th defendants were not properly enjoined in the suit as the plaintiff had not filed an amended plaint nor served the new defendants with summons and the plaint, as required by Order 1 Rule 10(4) of the Civil Procedure Rules. Furthermore, there was no evidence that the directors were personally served with the court orders. The failure to effect proper service was fatal to the application for contempt. Consequently, the application for contempt was dismissed for lack of merit.
