The court found that the Claimants' cause of action arose in 2006 when they were declared redundant or dismissed. At that time, the Employment Act, 2007 was not in force, and thus section 90 of that Act was inapplicable. The applicable law was the Limitation of Actions Act, which required that actions founded on contract be brought within six years. The Claimants commenced proceedings in 2015, well outside the limitation period, and failed to provide a statutory or contractual foundation for their claims.
