Ratio Decidendi

The court found that the Applicant failed to demonstrate that the Respondents were aware of or had been served with the court orders allegedly staying execution. There was no evidence that the Respondents had knowledge of the orders, nor was there a clear and unambiguous stay of execution order in place at the material time. The court further noted that the orders dismissing the application for want of prosecution did not amount to a stay of execution. As such, the Respondents were entitled to proceed with execution, and the requirements for contempt were not satisfied. The application was therefore dismissed for lack of merit.
