Ratio Decidendi

The court held that the Taxing Officer, not the High Court as a court of first instance, has the requisite jurisdiction to determine disputes on retainer and to tax Advocate-Client Bills of Costs. The Taxing Officer must first determine whether an advocate-client relationship exists when such a dispute is raised. The Taxing Officer erred in declining jurisdiction over the retainer dispute. The matter must therefore be remitted to the Taxing Officer for hearing and determination of the retainer issue and, depending on the outcome, taxation of the Bill of Costs. The High Court only exercises appellate jurisdiction in such matters if a party is aggrieved by the Taxing Officer's decision.
