The court found that there is a factual dispute as to whether the court orders have been complied with, as the applicant alleges non-compliance while the respondent asserts compliance and provides explanations for any delay. To resolve this, the court directed that P.C Calorine Akinyi, the deponent of the replying affidavit, be summoned to appear in court and provide evidence on the nature and extent of compliance with the subject court orders. This will enable the court to audit compliance and make a conclusive determination. The court thus deferred making a finding on contempt or enforcement until further evidence is provided.
