The High Court found that the Respondent’s Plaint dated 9th August, 2023 was incompetent for offending the doctrine of sub judice. The court determined that the subject matter in both the High Court suit and the lower court suit (MCCC No. E9366 of 2021) was substantially the same, as both sought to determine the parties’ obligations under the consent judgment and whether either party failed to fulfill those obligations. The mere addition of a new party (Stanbic Bank) in the lower court did not change the substance of the dispute. The lower court had already granted leave to amend pleadings and introduce third parties, and that ruling had not been challenged, appealed, or set aside....
