The High Court does not have jurisdiction to determine employment and labour relations disputes by virtue of Article 162 (2) (a) and Article 165 (5) (b) of the Constitution of Kenya. The Constitution mandates that such disputes be heard by specialized courts of equal status to the High Court, namely the Employment and Labour Relations Court. The Court of Appeal has affirmed that all employment and labour relations matters pending before the High Court should be transferred to the appropriate specialized court.
